Employer:
Any individual, company, or organization that registers on the Platform to post job opportunities, search for candidates, or engage with Talent.

Talent:
Any individual who creates a profile on the Platform to showcase skills, apply for jobs, or connect with Employers.

Services:
Includes all features and functionalities provided by the Platform, such as job postings, candidate search, messaging systems, profile creation, analytics, and any related services.

Content:
Any information, data, text, images, resumes, job listings, or other materials uploaded, shared, or displayed on the Platform by Users.

2. Eligibility

By using the platform, you confirm that:

  • You are at least 18 years of age or have reached the legal age of majority in your jurisdiction.
  • You possess the legal capacity and authority to enter into a binding agreement under applicable laws.
  • All information provided during registration or use of the Platform is accurate, complete, and up-to-date.
  • You will maintain the accuracy of your information and promptly update it if there are any changes.
  • You are not prohibited from using the Platform under any applicable laws or regulations.
  • If you are using the Platform on behalf of an organization, you confirm that you have the authority to bind that organization to these Terms.

3. Account Registration & Security

Users may be required to create an account to access certain features.

  • You are responsible for Maintaining the confidentiality of your login credentials.
  • You are responsible for All activities conducted under your account.
You must notify us immediately of any unauthorized access or security breach.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Employer Responsibilities

Employers using the platform agree to:

  • Provide accurate, complete, and non-misleading job descriptions, including role responsibilities, qualifications, compensation (if applicable), and work conditions.
  • Ensure that all job postings comply with applicable labor laws, employment regulations, and industry standards.
  • Use candidate data strictly for legitimate recruitment and hiring purposes only.
  • Maintain the confidentiality and security of candidate information and prevent unauthorized access or misuse.
  • Not discriminate against candidates on the basis of race, gender, religion, nationality, disability, sexual orientation, age, or any other protected characteristic under applicable laws.
  • Not misuse, sell, distribute, or commercially exploit candidate data obtained through the Platform.
  • Conduct fair and lawful hiring practices, including transparent communication and ethical evaluation processes.
Employers acknowledge and agree that they are solely responsible for all hiring decisions, employment offers, and interactions with candidates.

5. Candidate Responsibilities

Candidates using the Platform agree to:

  • Provide truthful, accurate, and up-to-date information in their profiles, resumes, and applications.
  • Ensure that all qualifications, experience, certifications, and achievements listed are authentic and verifiable.
  • Not impersonate any individual or entity, or misrepresent identity, skills, or affiliations.
  • Not upload or share false, misleading, or fabricated information.
  • Use the Platform in a professional manner when interacting with Employers.
  • Independently verify the authenticity, legitimacy, and suitability of Employers and job opportunities before proceeding.
Candidates acknowledge that they are responsible for their own job search decisions and interactions on the Platform.

6. Acceptable Use

Users agree to use the Platform responsibly and must not:

  • Post or promote fraudulent, deceptive, or misleading job listings or profiles.
  • Upload, share, or distribute any illegal, harmful, defamatory, obscene, or offensive content.
  • Attempt to hack, disrupt, overload, or interfere with the Platform’s functionality, servers, or security systems.
  • Use automated tools, bots, crawlers, or scraping technologies to collect data without prior written consent.
  • Engage in spamming, phishing, or fraudulent schemes.
  • Violate any applicable laws, regulations, or third-party rights.
Violation of these provisions may result in immediate suspension or termination of accounts, and may also lead to legal action where applicable.

7. Content Ownership

  • Users retain full ownership of the Content they upload to the Platform.
  • By submitting Content, you grant Midas Touch Operations a non-exclusive, worldwide, royalty-free, transferable license to:
    Display
    Store
    Process
    Reproduce
    Distribute
  • such Content as necessary to operate, maintain, improve, and promote the Platform and its Services.
  • You represent and warrant that:
    You have the legal right to upload such Content.
    Your Content does not infringe any intellectual property or third-party rights.

8. Privacy

Your use of the Platform is also governed by our Privacy Policy, which outlines how we:

  • Collect user data
  • Use and process information
  • Store and protect personal data

By using the Platform, you consent to the data practices described in the Privacy Policy.

9. Payments

The Platform may offer paid features or subscription-based services. By purchasing such services:

  • You agree to pay all applicable fees, charges, and taxes as per the selected pricing plan.
  • Payments must be made through approved payment methods.
  • Fees are non-refundable, except where explicitly stated otherwise or required by law.

  • Failure to make timely payments may result in service suspension or termination.

10. Platform Role

  • The Platform acts solely as an intermediary marketplace connecting Employers and Candidates.
  • We do not participate in or control:
    Hiring decisions
    Employment contracts
    Communication outside the Platform
  • We do not guarantee:

  • Employment opportunities for Candidates
  • Suitable or qualified candidates for Employers
  • Accuracy, completeness, or reliability of job postings or user profiles
Users are solely responsible for conducting their own due diligence, background checks, and verification.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Midas Touch Operations shall not be liable for:

  • Hiring or employment decisions made by Employers
  • Disputes, conflicts, or agreements between Employers and Candidates
  • Any direct, indirect, incidental, consequential, or punitive damages
  • Loss of data, revenue, business opportunities, or reputation
  • Unauthorized access to user accounts due to user negligence
  • Errors, interruptions, or unavailability of the Platform
Use of the Platform is entirely at your own risk.

12. Account Termination

We reserve the right to suspend, restrict, or terminate user accounts at our sole discretion, including but not limited to cases where users:

  • Violate these Terms and Conditions
  • Engage in fraudulent, abusive, or illegal activities
  • Provide false or misleading information
  • Harm the integrity, security, or reputation of the Platform or its users

Users may also terminate their accounts at any time by discontinuing use of the Platform.

13. Modifications to Terms

  • We reserve the right to update or modify these Terms at any time.
  • Significant changes will be communicated via:

    Email (where applicable)

Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law
